Justworks was founded in 2012 in New York with the Professional Employer Organisation model in mind — acting as co-employer for the employees of small businesses to give those businesses access to large-group benefits, streamlined payroll, and HR compliance support that they couldn't access at their own scale. The company differentiated from older PEO competitors through a modern, intuitive software experience that made the traditionally opaque PEO relationship transparent and self-serviceable, targeting the tech startup and small business communities in major metro markets that expected software to be well-designed as a baseline.

As a PEO, Justworks is the employer of record for the employees of its client companies — it handles payroll processing, tax filings, benefits administration, workers' compensation, and compliance across the states where clients have employees. The platform serves both the HR administrators at client companies who configure payroll settings, manage employee onboarding, and handle benefits elections, and the individual employees who access their own paystubs, tax documents, and benefits information through the Justworks employee portal and mobile app. Because Justworks holds the employer-of-record relationship, its systems are the official record of employment for regulatory purposes.

Justworks platform outages affect both the businesses that use it and the employees who depend on it for access to their employment records. HR administrators cannot process payroll during backend degradation, which if it coincides with a processing deadline creates a regulatory compliance risk under state wage payment timing laws. New employee onboarding — which requires completing I-9 verification, direct deposit setup, and benefits elections through the Justworks platform — stalls when the onboarding workflow system is unavailable. Employees cannot access pay stubs or tax documents during portal downtime.
